Child Support

The payment of child support is affected by the income of the parent paying the support, as well as the parenting arrangements that are in place. The amount of child support is dictated by the Child Support Guidelines, and may be affected by factors specific to each case.

Divorce

Spousal support (alimony)

Entitlement to spousal support is not automatic. Our experienced team will help you determine if spousal support is payable and, if so, who is responsible for paying it, how much is paid, and for how long.

Guardianship

In British Columbia, there is a difference between being a parent and being a guardian of a child. As a guardian, a person is entitled to participate in decision-making for a child, and must also assume the responsibilities that come with raising children.

Prenuptial agreements/cohabitation agreements

Investing in a comprehensive prenuptial or cohabitation agreement can help couples reduce or completely avoid legal difficulties that may arise at the end of a relationship.

Parenting Co-ordinator

A parenting coordinator can help families settle disputes about their children without going to court. Through parenting coordination, the delay and expense of the regular court process is reduced as the parenting coordinator works with parents to build conflict-resolution skills. These skills assist parties and, ultimately, families in the long term.

Mediation / Arbitration

Mediation allows people to work with a mediator to find a creative solution that works for everyone. It allows for the greatest amount of control over the outcome, because everyone must consent to the agreement.

In an arbitration, the participants decide who the arbitrator is, and give them the authority to make a legally binding decision about the issue. Participating in mediation and arbitration can reduce the time and cost needed to settle one or more issues.

Collaborative law

Deb is trained in collaborative law. However, Deb does not practice “collaborative law” in its strictest sense. Her concern is that if the formal “collaborative law” process breaks down, both parties must retain new lawyers, and start the legal process from the beginning again. To start the process again is extremely expensive and time consuming. Deb’s personal view is that family lawyers should behave and attempt to act collaboratively on every file, using every effort to settle matters, and if it can’t settle, the best lawyer to take the matter to court is the lawyer who tried to settle.

Meeting

We start with an initial consultation to understand your situation and goals. This meeting allows us to gather details and answer your questions so you feel confident moving forward.

Negotiation
Process

In negotiation (which can include mediation), we facilitate constructive communication between you and your ex-partner. This step aims to reach an agreement that focuses on the best interests of your children.

Final
Resolution

Once an agreement is reached, we assist you in finalizing the documentation. Our goal is to ensure that the resolution is fair and remains beneficial for your family.

If an agreement cannot be reached, Deb can represent you in Court, and use her years of experience to make sure your case is given a full and fair hearing.
